By securing a charter or utilizing our Service, you consent to be bound by these Terms. Should you not agree with any segment of these terms, then you are prohibited from accessing the Service.

2. Service Overview

PublicCommonsLounge offers luxury yacht charter services, inclusive of but not restricted to:

  • Day-long yacht rentals
  • Evening cruises
  • Corporate getaways
  • Exclusive gatherings
  • Extended charters

All services are contingent upon availability and weather conditions. We maintain the authority to adjust or discontinue services at our discretion.

3. Booking and Reservations

3.1 Booking Process

To secure a yacht, you are required to:

  • Be at minimum 18 years of age
  • Supply precise and comprehensive details
  • Settle the requested deposit as stipulated in your booking confirmation
  • Accept these Terms & Conditions

3.2 Confirmation

Your reservation is only ratified following the receipt of payment and our written confirmation. We reserve the right to decline service to anyone at our sole discretion.

3.3 Availability

All charters are subject to the availability of the vessel and favorable weather conditions. We will strive to accommodate your desired dates and times.

4. Payment Terms

4.1 Pricing

All pricing is presented in € and incorporates all applicable taxes unless indicated otherwise. Pricing is subject to alteration without prior notice.

4.2 Payment Schedule

  • Deposit: 50% of the total charter fee is due at the time of booking
  • Balance: Payable 48 hours in advance of charter departure
  • Incidental charges (if applicable): Payable following the completion of the charter

4.3 Payment Methods

We accept recognized credit cards, electronic bank transfers, and certified cheques. Our payment processes are conducted through secure, encrypted channels.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • Greater than 72 hours before departure: Complete refund minus service fees
  • 24-72 hours prior to departure: Partial refund of 50%
  • Fewer than 24 hours before departure: No refund is provided

5.2 Weather Cancellations

If the weather is deemed unsuitable for sailing by our captain, we will propose to:

  • Reschedule the charter to another available date at no extra charge
  • Issue a full refund if rescheduling proves impossible

5.3 Mechanical Issues

Should there be technical issues with the designated vessel, we will try to arrange a comparable alternative. If a suitable substitute is unavailable, we will issue a full refund.

6. Safety and Conduct

6.1 Safety Requirements

All guests are expected to:

  • Heed all directives from the crew
  • Utilize provided safety gear as needed
  • Declare any health conditions that may impact their safety
  • Stay within the assigned sections of the vessel

6.2 Prohibited Items

The following are not permitted on board:

  • Glass containers
  • Unlawful substances
  • Firearms or any form of weapon
  • Excessive quantities of refreshments (beyond what's reasonable for personal consumption)
  • Animals (except if previously approved)

6.3 Conduct

Passengers are expected to behave respectfully. We retain the right to end a charter prematurely, without a refund, if a passenger's conduct endangers safety or disrupts the excursion for others.

7. Liability and Insurance

7.1 Our Liability

Our liability is confined to the amount paid for your charter. We are not accountable for:

  • Personal injuries sustained due to passenger recklessness
  • The loss or theft of personal belongings
  • Indirect, consequential, or punitive damages
  • Delays due to weather or other conditions beyond our authority

7.2 Insurance Coverage

Comprehensive marine insurance is maintained for our vessels and operations. It is the passenger's responsibility to secure their own travel and private insurance.

7.3 Assumption of Risk

By engaging in our charter services, you recognize that maritime activities contain inherent dangers and you accept the onus for your personal safety and welfare.

8. Modifications and Itinerary Changes

We keep the right to alter itineraries, courses, or timetables due to weather considerations, safety needs, or operational demands. We will make every attempt to offer equivalent alternatives.

9. Force Majeure

We are not liable for postponements, cancellations, or alterations caused by events outside our control, including but not restricted to:

  • Severe meteorological conditions
  • Natural calamities
  • Regulatory decrees
  • Suspension of port operations
  • Equipment malfunctions

10. Privacy and Data Protection

Your personal data is processed in line with our Privacy Policy. By employing our services, you agree to the gathering and use of your information as outlined in our Privacy Policy.

11. Intellectual Property
